Website in a Day & Website in a Week – Terms & Conditions

By purchasing and registering for either the Website in a Day or Website in a Week service (herein referred to as the "Services"), the following Terms and Conditions (the "Terms") are entered into by Sand and Silk ("Company," "we," or "us") and You ("Client" or "You"), and You agree to the following terms stated herein. The Company and You may be referred to individually as a "Party" and collectively as the "Parties" in these Terms.
1. Service Description
Website in a Day includes:
- A full one-day website design experience using Showit.
- Customization of a website template or light custom design as discussed during the consultation.
- Up to 5 pages, including the Homepage, About, Services, Portfolio and Contact page. (Any legal pages will need to be purchased by Client separately)
- A provided brand colors palette, consisting of 4-6 colors, 2-3 fonts, and a brand vision.
- A 1-hour brand strategy call if deemed necessary via Google Meet.
- A 30-minute Kickoff Call via Google Meet.
- Basic mobile and desktop optimization.
- One (1) round of revisions during the scheduled day.
- Handoff of the final website via Showit Share Key for You to upload into Your own Showit account.
- A Website Handoff Guide with instructions for managing Your new site.
Website in a Week includes:
- A one-week website design experience using Showit.
- Customization of a website template or light custom design tailored to the Client’s brand and business needs.
- Up to 5 pages, including the Homepage, About, Services, Portfolio and Contact page. (Any legal pages will need to be purchased by Client separately).
- Wordpress integration for Blog set up
- A provided brand colors palette, consisting of 4-6 colors, 2-3 fonts, and a brand vision.
- A 1-hour brand strategy call via Google Meet.
- Basic mobile and desktop optimization.
- A 30-minute Kickoff Call via Google Meet before the project start date.
- Up to three (3) rounds of revisions throughout the project timeline.
- Handoff of the final website via Showit Share Key.
- A Website Handoff Guide with instructions for managing Your new site.
- For both services, the Client must provide all required materials, including branding assets, website copy, images, and domain access, at least 48 hours before the scheduled project start date. Failure to do so may result in rescheduling fees or project cancellation.
2. Project Timeline & Revisions
Each project is subject to vary based on Client needs.
Website in a Day Timeline (9 AM - 5 PM HST)
- 9:00 AM: Kickoff Call & Strategy
- 10:00 AM - 12:00 PM: Website Setup, Branding, & Homepage Design
- 12:00 PM - 1:00 PM: Page Layouts & Structure
- 1:00 PM - 3:00 PM: Client Review & Revisions (One Round)
- 3:00 PM - 4:00 PM: Final Touches & Handoff Preparation
- 5:00 PM: Website Delivery & Wrap-up
Website in a Week Timeline
- Day 1: Kickoff Call & Strategy
- Day 2: Initial Design & Homepage
- Day 3: Page Layouts & Branding
- Day 4: Client Review & Revisions (Round 1)
- Day 5: Revisions 2 & Content Adjustments
- Day 6: Final Revisions & Testing
- Day 7: Website Delivery & Wrap-up
For Website in a Day, the Client is allowed one (1) round of revisions during the project day. For Website in a Week, the Client is allowed three (3) rounds of revisions, with feedback required within 24 hours of receiving updates. Additional revisions beyond the allotted rounds will be billed at $125/hour.
3. Payment Terms
Website in a Day: $3,000 (or promotional rate, if applicable).
Website in a Week: $5,000 (or promotional rate, if applicable).
Full payment is required prior to the commencement of the Service. A payment plan option is available, dividing the cost into two (2) payments. The first payment must be received before the scheduled project start date, and the final payment is due 1 month after the project start date. Payments will be collected via ThriveCart. No work will commence until full payment or the first installment is received. All sales are final, and no refunds will be issued after payment has been processed.
4. Late Fees & Rescheduling
If the Client fails to provide necessary materials on time, the Designer reserves the right to charge a late fee of $100 per day until materials are received. If the Client fails to make a scheduled payment on time, a late fee of 1.5% of the outstanding amount per day will be applied, beginning seven (7) days after the due date. If delays caused by the Client necessitate rescheduling the project, a rescheduling fee of $200 will be charged in addition to any late fees incurred. The Designer will notify the Client in writing if any late fees are applied.
5. Refund Policy
Due to the time-sensitive nature of these services, no refunds will be issued once the project has begun.
6. Ownership & Intellectual Property
The completed website will be delivered via Showit Share Key, which the Client must upload to their own Showit account. The Client must have an active Showit subscription before the project start date. The Client is responsible for purchasing and uploading any paid fonts required for the design. All work remains the intellectual property of Sand and Silk until full payment is received. The Designer retains the right to display the final website in their portfolio and marketing materials unless otherwise agreed in writing.
7. Confidentiality & Liability
Both Parties agree to keep confidential any sensitive business or design-related information shared during the project. The Designer is not responsible for any third-party issues, including but not limited to Showit hosting, domain setup, or external software integrations. The Designer does not guarantee specific business results, conversions, or website traffic from the Services. The Client is responsible for all post-launch maintenance and updates unless additional services are contracted separately.
8. Governing Law & Dispute Resolution
This Agreement shall be governed by and interpreted in accordance with the laws of Hawaii. Any disputes shall first be attempted to be resolved through mediation. If mediation fails, disputes will be settled in the state or federal courts of Maui, Hawaii.
9. Agreement to Terms
By purchasing either Website in a Day or Website in a Week, You acknowledge that You have read and agree to these Terms and Conditions. These Terms constitute the full agreement between the Company and the Client regarding these services.
